USER AGREEMENT – TERMS & CONDITIONS
The terms and conditions of this User Agreement outline the rules and regulations which constitute a legally binding agreement between you and the Company – Atvi Infotainment Private Limited, regarding your use of the web site i.e www.eastmojo.com (hereinafter referred to as the “Site”) and any services offered by the company including but not limited to delivery of content via the Site, any mobile or internet connected device or otherwise (hereinafter referred to as “the Services”).
By accessing the Site, you hereby agree to be bound by these Terms and conditions. You hereby represent and warrant to the Company the following:
(i) that you are at least eighteen (18) years of age or above and that you are capable of entering, performing and adhering to these Terms and conditions; (ii) In the event that you are under the age of 18, you may utilise the service of the site with the involvement & guidance of your parents or legal guardians, under such Parent/Legal guardian’s registered account.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notices and all Agreements:
Any reference to the terminologies “User”, “You” and “Your” would mean and imply the person logging on to this site for the purpose of accessing or availing the site of the Company for the purpose of hosting, publishing, sharing, transacting, displaying or uploading information or views and includes other persons jointly participating in using the site of the Company. Any reference to the terminologies “The Company”, “Ourselves”, “We”, “Our” and “EastMojo” would mean and imply Atvi Infotainment Pvt. Ltd. Any reference to the terminologies “Party”, “Parties”, or “Us”, would mean and imply both the person logging on to the site and the Company.
The Company on its own discretion shall be at the liberty to add to or change or update this User Agreement from time to time. It shall be your responsibility for checking the User Agreement periodically to remain in compliance with it. Your use of the site after any amendments made to the Agreement shall constitute your acceptance of this User Agreement and any amendments/changes/ revisions made to it.
Limited Permission to Copy for personal and individual use only
The Company grants you permission to only access and make personal use of the Site and you agree not to, directly or indirectly download or modify / alter / change / amend / vary / transform / revise / translate / copy / publish / distribute or otherwise disseminate any content on the Site / Service, or any portion of it; or delete or fail to display any promotional taglines included in the Site / Service either directly or indirectly, except with the express consent of the Company. However, you may print or download extracts from these pages for your personal / individual, non-commercial use only. You are not allowed to retain any copies of these pages saved to disk or to any other storage medium except for the purposes of using the same for subsequent viewing purposes or to print extracts for personal / individual use. You further agree not to (whether directly or through the use of any software program) create a database in electronic or structured manual form by regularly or systematically downloading and storing all or any part of the pages from this site.
Prohibition on Commercial use
The Company prohibits you from any attempts to resell or put to commercial use any part of the Site; any collection and use of any product listings, descriptions, or prices; any derivative use of the Site or its contents; any downloading or copying of account information for the benefit of any other merchant or entity; any renting, leasing, or otherwise transferring rights to the Site / Service; displaying the name, logo, trademark or other identifier of another person (except for eastmojo.com or you) in such a manner as to give the viewer the impression that such other person is a publisher or distributor of the Service on the Site, or any data gathering or extraction tools; or any use of meta tags.
No part of the Site may be reproduced or transmitted to or stored in any other web site, nor may any of its pages or part thereof be disseminated in any electronic or non-electronic form, nor included in any public or private electronic retrieval system or service without prior written permission. Individual Registration, Access and Exchange of Information
For certain services such as email, contests and newsletter, registration by the visitor is required. In order to access these services, you will have to register for these services and for that you will have to open an account by undertaking the registration process which shall include but not limited to providing us with current, complete and accurate information as prompted by the applicable registration form. You will have to choose a user name and a password. You are entirely responsible for maintaining the confidentiality of you are your account and your password. By registering, you agree to the following terms in addition to any other specific terms which shall be posted at an appropriate location of the Site. Each registration is for a single individual user only. The Company does not permit any part of the Site being cached in proxy servers and accessed by individuals who have not registered with EastMojo as users of the Site; or Access through a single account and Password being made available to multiple users on a network. For any misuse of account or password in any manner, the Company reserves the right to cancel access rights immediately without notice, and block access to all users from that IP address.
Furthermore, you shall be entirely responsible for any and all activities that occur under your account. In the event of any unauthorized use of your account or any other breach of security, you hereby agree to notify the Company immediately. The Company will not be liable for any loss that you may incur as a result of someone else using your password or account. However, you could be held liable for losses incurred by the Company or another party due to someone else using your account or password.
Material Posted/transmitted on the Site
All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly or privately transmitted / posted, is the sole responsibility of the person from where such content is originated (the Originator). By posting any material which contain images, photographs, pictures or that are otherwise graphical in whole or in part (“Images”), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by this User Agreement, (b) you have the rights necessary to grant the licenses and sub-licenses described in the terms of this User Agreement, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in the terms of this User Agreement, including, by way of limitation, the distribution, public display and reproduction of such Images.
You represent that you have valid rights and title in any and all Content/Images that you submit on the Site, that you have not infringed on any IPR belonging to any party and further that you will indemnify the Company or its affiliates for all claims arising out of any content that you post on the Site.
Posting/uploading of any information or material, which is harmful, defamatory, obscene, pornographic, libellous, invasive of another’s privacy, profane, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner is prohibited and any person found to be involved in such activity on this site will solely be liable for actions under the applicable laws.
The Company accepts no responsibility for the said Content / Images. However, you understand that all Content / Images posted by you becomes the property of the Company and you agree to grant/assign to the Company and its affiliates, a non-exclusive, royalty free, perpetual, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content / Images (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed throughout the world”.
Intellectual Property Rights
Unless otherwise expressly stated, copyrights and all intellectual property rights in all materials (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on this site are the property of the Company and its affiliates and associates and are protected under applicable Indian laws. You agree not to use any framing techniques to enclose any trademark or logo or other proprietary information of the Company and any infringement of any Intellectual Proprietary rights of the Company shall be addressed under applicable Indian Laws.
No unlawful or prohibited use
You hereby agree not to use the site or the services for any purpose that is unlawful or prohibited by the terms and conditions of this User Agreement. You hereby agree not to use the site and services in any manner that could damage, disable, overburden, or impair any EastMojo ‘s server, or the network(s) connected to any EastMojo server, or interfere with any other partys’ use and enjoyment of any Services. You agree not to attempt to gain unauthorized access to any Services, other accounts, computer systems or to any of the Services, through hacking, password mining or any other means. You hereby agree not to obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
Exchange of Information qua CHAT & other Community Services
The Company endeavours to provide a web platform for various community interactions for persons to interact and exchange views with each other. The content posted on such services is by the general public and therefore the Company does not guarantee the accuracy, integrity or quality of such content.
You hereby agree that by using the facility of chat and other community services you shall be solely responsible for all Content that you upload, post or otherwise transmit and such upload, post, or transmission on any matter or views cannot be defamatory, abusive, pervasive, obscene, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable. You also hereby agree not to indulge in cyber stalking, become or create a nuisance for any visitor / user of the Site.You hereby agree not to send, submit, post, or otherwise transmit, material or messages that may contain software virus, or any other files that are designed to interrupt, destroy, and negatively affect in any manner whatsoever, any electronic equipment in connection with the use of this Site, or other user’s ability to engage in real time exchanges.
Prohibited Activities
Apart from the prohibited activities hereinabove mentioned, you are further prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing any information on the Site, that —
a) Belongs to another person and to which you have no right;
b) Impersonates another person or deceives or misleads the addressee about the origin of such messages;
c) Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, harmful to minors, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever or violates any law for the time being in force;
d) Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.
Any Content uploaded by you shall be subject to relevant laws and if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Site, we may terminate your account/block your access to the Site and we reserve the right to remove any non-compliant comment or Content uploaded by you and the Company shall further have the right to take recourse to such remedies as would be available to the Company under the applicable laws.
Grievance Redressal :
Any complaints or concerns with regards to content and or comment or breach of these terms shall be taken up with the designated Grievance Officer for the respective site as mentioned below via in writing or through email at their respective email id, signed with the electronic signature to the respective Grievance Officer
