Guwahati: In another incident of rape in the state capital, Assam police have arrested 38-year old Bamun Sharma in connection with rape of a 12-year old minor girl on Tuesday.
Sharma, a resident of Bhaskar Nagar, has been apprehended by police officials from the Geetanagar police station, after the mother of the victim filed an FIR against him.
The victim child narrated the incident to her mother based on which the mother filed a complaint at the Geetanagar police station.
The police have registered a case under Section 376 of Indian Penal Code (IPC) and Section 5 of Protection of Child from Sexual Offences (POCSO) Act.
Section 376 of IPC states punishment for sexual assault – 1 (a) whoever, except in the cases provided for by sub-section (2) commits sexual assault shall be punished with imprisonment of either description for a term which shall not be less than seven years but which may extend to 10 years and shall also be liable to fine.
Section 5 of the POCSO act states aggravated Penetrative Sexual Assault (Section 5) , punishment of which is stated in section 6 of the act– not less than twenty years which may extend to imprisonment for life, and fine
“A FIR was filed on October 12 that a minor girl was raped. We acted swiftly and apprehended the accused from his residence, ” said Bhaskar Jyoti Baruah, sub inspector at Geetanagar police station.
