The development comes a day after Centre issued notification to hand over probe to CBI on recommendation by Bihar govt

Mumbai: The Central Bureau of Investigation (CBI) on Thursday filed an FIR in Sushant Singh Rajput’s death case against actor Rhea Chakraborty and her family members Indrajit Chakraborty, Sandhya Chakraborty, and Showik Chakraborty.

Apart from family members, a case has also been registered against Rhea’s associates Samuel Miranda and Shruti Modi.

The development comes a day after the Centre issued a notification to hand over the probe to CBI on the recommendation by Bihar government. The FIR is based on the one registered by the Bihar police in Patna. Names of Rhea and her family members, apart from two others, have been registered over various suspected offenses. These include criminal conspiracy, wrongful restraint, and abetment of suicide, criminal breach of trust, theft wrongful confinement, criminal intimidation, and cheating.

According to the CBI FIR, the case (FIR No. 241/2020 dated 25.07.2020) is registered under section 341, 342, 380, 406, 420, 306, 506, 120B of the Indian Penal Code, PS- Rajiv Nagar, and District-Patna. Previously, CBI had informed that they were in touch with Bihar police who had first registered the FIR against Rhea, Rajput’s former live-in partner including her family members.

If sources are to be believed, CBI’s Special Investigation Team (SIT), will probe into the Rajput case. They are the ones who are currently investigating the AgustaWestland scam and bank fraud case against Vijay Mallya.

Maharashtra government, on the other hand, is strongly opposing the handing over of the case to CBI. They claim that it was done for political reasons which include the upcoming assembly polls in Bihar. Additionally, issues of jurisdiction were also raised by the Maharashtra government as they claim that Bihar police or government has no locus standi in the case since the actor’s death took place in Mumbai and not Patna.

But after Sushant’s father alleged about a cover-up by the Mumbai police to save ‘influential’ people, the case was handed over to the CBI. Additionally, they also accused the Mumbai police of deliberately ignoring leads in the case and even destroying evidence in an attempt to derail it. The Maharashtra government and the Mumbai Police have vehemently denied the allegations.

Based on the Bihar police’s FIR and the complaint given by Rajput’s father, the CBI has only invoked the initial sections. This can be modified at a later stage as per the developments in the probe. The case is also handed over to the anti-corruption unit VI (SIT), given the economic aspects of the case and also the recent controversies (turf war between Bihar and Mumbai police).

CBI will be collecting all the case related documents both from Bihar and Mumbai police and will also study the autopsy report. Before summoning the accused for questioning, CBI will also study the statements recorded by the Mumbai Police. Additionally, psychological testing will also be conducted to shed light on the case. Moreover, a team will also visit Rajput’s Mumbai residence and get a fresh look at the crime scene.

The prime focus of CBI’s case will also be on Rhea as the agency has also taken over the case registered against her in Bihar. She has been summoned by the Enforcement Directorate on Friday for questioning the alleged financial misconduct in the case.
