Agartala: The West district Judicial Magistrate Court today granted interim bail to all four accused of harassing and spitting on a doctor at a COVID care centre on July 24.

Additional government advocate Karnajit De is among the four accused. They had prevented West district health officer, Dr Sangita Chakraborty and her medical team from admitting newborn babies and their mothers at the COVID care centre.

Three days after the incident, on July 27 the director of health services filed an FIR in the New Capital Complex (NCC) police station under several sections including section 3 (2) (I) of Epidemic Diseases Amendment Act 2020, section 3 of Tripura Medicare Service Persons and Medicare Service Institution (Prevention of Violence and Damage Property Act) 2013.

Samrat Kar Bhowmik, the counsel of accused additional government advocate Karnajit De, said that the accused persons were kept in a room in the Bhagat Singh Hostel where all the inmates were male members.

“At a time, they suddenly heard the cry of an infant, and they noticed that female inmates with their babies were brought there. The inmates at a time took objection to the same as they did not expect female inmates to stay in the same room as male patients,” Bhowmik said.

The judicial magistrate, Sanjan Lal Tripura after hearing both said, “I find the present factual circumstances of the case does not justify police remand and accordingly the prayer for police remand stands declined.”

The court further said that as provided, it is the duty of the court to satisfy that the requirements as provided are duly complied. “I come to the conclusion that the investigating officer stated that the facts consisting the basic of his conclusion or reason of making the arrest and accordingly as provided I decline to grant any remand”, the court order added.

The accused persons are on interim bail till August 29 after furnishing a bail bond of Rs 30,000 each.
