A trial court accepted the IIT Guwahati rape victim’s request to impound the passport of accused Utsav Kadam on Wednesday, but postponed the framing of the charges to September 1, 2021.
Following Utsav Kadam’s bail on August 13, 2021, the additional district and sessions court at Amingaon had scheduled the framing of charges on August 25, 2021. However, Kadam’s counsel filed an application praying for adjournment on the ground that some materials on record applied for are yet to be received (by the accused).
The prosecution’s counsel for the victim in the case ‘State of Assam v. Utsav Kadam’, however, moved in an application requesting the court to impound his passport.
“… the victim prays that she may be heard and that upon such an application being filed by the accused for moving out of the territorial jurisdiction of this Hon’ble Court is granted by this Hon’ble Court, this Hon’ble Court may be pleased to impound the passport of the accused. For, there is every likelihood of the accused thwarting justice by fleeing the borders of this country.”
“That there is a real threat of apprehension and fear on the part of the applicant/victim that the above-named accused is likely to thwart justice by jumping bail and escaping the borders of this country as his parents are financially sound; both are earning members,” the victim’s counsel submitted.
“In the premises aforesaid, it is most respectfully prayed that this Hon’ble Court may be graciously pleased to hear the victim/accused in the event a prayer for leaving the territorial jurisdiction of this Hon’ble Court is made by the accused and in the event such a prayer is deemed fit to be granted by this Hon’ble Court, the passport of the accused is impounded by this Hon’ble Court and/or pass such order/s as may seem fit and proper,” the counsel added in the application.
August 25 was the date fixed for hearing on framing of charges. A counsel for the victim, however, said the accused, who was present in court, filed an application praying for adjournment on the ground that some materials on record applied for are yet to be received (by the accused).
“The victim applied for impoundment of the passport of the accused who has also prayed for staying beyond the territorial jurisdiction of the trial court, which was granted. The next date fixed for hearing on charges is September 1, 2021,” the counsel said.
Meanwhile, Utsav Kadam remains suspended from IIT Guwahati. His suspension letter dated April 4, 2021, stated, “This is with reference to the incident of ragging, substance abuse and sexual assault on March 28, 2021, and March 29, 2021, in the IITG campus and further arrest by the police on April 3rd, 2021. The undersigned is to convey that the institute is suspending Mr. Utsav Kadam, Roll No: 180107076, with immediate effect (i.e. from 04.04.2021).”
